1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between Cally Technologies — Özkan Akçay ("Developer", "we") and you ("User"). By installing or using the Cally app, you agree to these Terms in full.

2. Service Description & Core Roles

Cally is an all-in-one telephony and communication security platform:

  • Default Phone Dialer: Call placement, answering, call history, and contact management
  • Default SMS Handler: SMS/MMS messaging and anti-spam text defense
  • Cally AI Guard: Machine learning scam detection and call takeover
  • Cally Chat: AES-256 encrypted on device, stored encrypted on the server (not end-to-end encrypted — see Privacy Policy)
  • On-Device Call Recording: User-controlled local voice recording
  • Premium & Community: Caller ID lookup, confessions, and family safety circle

3. Acceptable Use & Prohibited Conduct

When using Cally:

  • Engaging in fraud, harassment, impersonation, or illegal activities is strictly prohibited.
  • Sending unsolicited bulk SMS (spam) or automated robocalls is forbidden.
  • Reverse engineering, decompiling, or copying the source code is prohibited.
  • Accessing servers using automated scrapers or bots is prohibited.
  • Submitting false spam reports against innocent numbers is prohibited.

4. Premium Subscriptions & Pricing

Cally offers premium subscription tiers. All paid tiers (PRO, VIP, ELITE, PREMIUM) include the same core feature set: unlimited number lookups, AI Guard protection, call recording, and an ad-free experience. Tiers differ only in price, monthly coin bonus, and the following extra entitlements:

  • PRO Plan: ₺49/month or ₺352/year
  • VIP Plan: ₺99/month or ₺713/year — plus social profile lookup
  • ELITE Plan: ₺199/month or ₺1,432/year — plus social profile lookup
  • PREMIUM Plan: ₺499/month or ₺3,592/year — plus social profile lookup and clan (community group) creation

All purchases are processed via Google Play In-App Billing. Subscriptions auto-renew unless cancelled at least 24 hours prior to renewal.

5. Cancellation & Refund Policy

  • How to Cancel: Open Google Play Store → Profile → Payments & Subscriptions → Subscriptions → Cally and tap Cancel.
  • Active Access: Premium benefits remain fully accessible until the current paid period expires.
  • Refunds: Refund requests are governed by Google Play's standard Refund Policies.
  • Notice: Deleting the app or your account does not cancel your Google Play subscription; you must cancel through Google Play directly.

6. AI & Cally Guard Disclaimer

Cally AI Guard provides automated risk signals and advisory warnings. It does not provide definitive legal proof or guarantee 100% accuracy. The decision and liability regarding responding to callers rests solely with the user. Cally Technologies is not liable for damages resulting from automated alerts.

7. Call Recording Legal Compliance

Obtaining consent from the other party before recording calls in accordance with wiretapping and eavesdropping statutes is the sole responsibility of the user. Legal liability for unauthorized recordings rests with the user.

8. Social Profile & Community Rules

You confirm that linked Instagram, Twitter/X, or TikTok handles belong to you. Impersonating another person is strictly prohibited and results in immediate account termination.

9. Intellectual Property

All source code, designs, algorithms, logos, and trademarks of Cally belong exclusively to Cally Technologies — Özkan Akçay. Unauthorized copying, distribution, or reproduction is forbidden.

10. Limitation of Liability

The service is provided "as is". Cally Technologies is not liable for indirect or consequential damages arising from telecom operator disruptions, delayed SMS, or network downtime.

11. Account Deletion & Termination

You can delete your account and data at any time via Profile → "Delete Account". We reserve the right to terminate accounts that violate these Terms.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Turkey. Turkish Courts and Enforcement Offices have exclusive jurisdiction.
